Terms of Use

1. Acceptance of Terms

By downloading, installing, accessing, or using the InKuber application ("App", "Service", "we", "our", or "us"), you ("User", "you", or "your") agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and InKuber. Please read them carefully before using the App.

2. Description of Service

InKuber is a mobile application that allows users to connect to and manage Kubernetes clusters from iOS devices. The App provides functionality including but not limited to:

• Connecting to Kubernetes cluster API servers
• Viewing and managing Kubernetes resources (pods, deployments, services, etc.)
• Viewing container logs
• Executing commands in containers
• Monitoring cluster metrics

The App is a tool that facilitates direct interaction with your Kubernetes clusters. All actions performed through the App are executed directly on your clusters.

3. User Responsibilities

By using InKuber, you acknowledge and agree that:

• You are solely responsible for all actions performed through the App on your Kubernetes clusters
• You have the proper authorization to access and manage the Kubernetes clusters you connect to
• You understand Kubernetes and the potential consequences of the operations you perform
• You are responsible for maintaining backups of your data, configurations, and cluster resources
• You are responsible for securing your device, credentials, and access tokens
• You will comply with all applicable laws, regulations, and third-party agreements when using the App

4. Assumption of Risk

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE APP IS AT YOUR SOLE RISK. Kubernetes cluster management involves inherent risks including but not limited to:

• Accidental deletion of pods, deployments, services, or other resources
• Data loss or corruption
• Service disruptions and downtime
• Unintended configuration changes
• Security vulnerabilities if credentials are compromised
• Resource exhaustion or cluster instability
• Loss of business revenue or opportunities

You assume full responsibility for any and all risks associated with using the App to manage your Kubernetes infrastructure.

5. No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.

To the maximum extent permitted by applicable law, we expressly disclaim all warranties, including but not limited to:

• IMPLIED WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE

We do not warrant that:

• The App will meet your requirements or expectations
• The App will be uninterrupted, timely, secure, or error-free
• The results obtained from the App will be accurate or reliable
• Any errors in the App will be corrected
• The App will be compatible with all Kubernetes versions or configurations

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER OF INKUBER BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES
• COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES
• BUSINESS INTERRUPTION OR LOSS OF BUSINESS INFORMATION
• DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA
• DAMAGES RESULTING FROM ANY ACTIONS TAKEN THROUGH THE APP

This limitation applies regardless of:

• The theory of liability (contract, tort, negligence, strict liability, or otherwise)
• Whether we were advised of the possibility of such damages
• Whether such damages were foreseeable

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY US DOLLARS ($50), WHICHEVER IS GREATER.

7. Specific Disclaimers for Kubernetes Operations

You specifically acknowledge and agree that:

• Deletion Operations: Any delete operations (pods, deployments, services, namespaces, persistent volumes, etc.) performed through the App are permanent and may result in irreversible data loss. We are not responsible for any data loss resulting from delete operations.
• Configuration Changes: Modifications to Kubernetes resources may cause service disruptions, application failures, or data loss. You are solely responsible for reviewing and understanding all changes before applying them.
• Command Execution: Commands executed in containers through the App's terminal feature run with the privileges of the container. We are not responsible for any consequences of commands you execute.
• Cluster Access: The App connects directly to your clusters using credentials you provide. We do not control, monitor, or validate the actions performed on your clusters.
• No Backups: The App does not create backups of your data or configurations. You are solely responsible for maintaining adequate backups.
• Third-Party Infrastructure: We are not responsible for the availability, performance, or security of your Kubernetes clusters, cloud providers, or any third-party services.

8. Indemnification

You agree to indemnify, defend, and hold harmless the developer of InKuber from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney's fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of any third party
• Any actions performed on Kubernetes clusters through the App
• Any data loss, service disruption, or damages resulting from your use of the App
• Your failure to maintain adequate backups or security measures

9. Acceptable Use

You agree not to use the App to:

• Access clusters or systems without proper authorization
• Perform any illegal activities
• Interfere with or disrupt services, servers, or networks
• Attempt to gain unauthorized access to any systems
• Transmit malware, viruses, or harmful code
• Violate any applicable laws or regulations

10. Intellectual Property

The App and its original content, features, and functionality are owned by InKuber and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Kubernetes is a registered trademark of The Linux Foundation. InKuber is not affiliated with, endorsed by, or sponsored by The Linux Foundation or the Kubernetes project.

11. Credential Security

You are solely responsible for:

• The security of your Kubernetes credentials and access tokens
• Protecting your device from unauthorized access
• Using appropriate authentication methods for your clusters
• Revoking access tokens if your device is lost or compromised

We store credentials locally on your device using iOS Keychain but cannot guarantee the security of your credentials if your device is compromised.

12. Service Availability

We do not guarantee the continuous availability of the App. The App may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue the App at any time without notice.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by updating the "Last updated" date at the top of this page. Your continued use of the App after any changes constitutes your acceptance of the new Terms.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the use of the App shall be resolved through binding arbitration in accordance with applicable arbitration rules. You waive any right to participate in a class action lawsuit or class-wide arbitration.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and InKuber regarding the use of the App and supersede all prior agreements and understandings.

17. Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights. The waiver of any such right or provision will be effective only if in writing and signed by the developer of InKuber.

19. Acknowledgment

BY USING INKUBER, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF USE. YOU FURTHER ACKNOWLEDGE THAT THESE TERMS CONSTITUTE A COMPLETE AND EXCLUSIVE STATEMENT OF THE AGREEMENT BETWEEN YOU AND INKUBER, AND THAT THEY SUPERSEDE ANY PRIOR OR CONTEMPORANEOUS AGREEMENTS, COMMUNICATIONS, AND PROPOSALS, WHETHER ORAL OR WRITTEN, BETWEEN YOU AND INKUBER.
